1. Who We Are
CustomAssessment is a service operated by Euvouria LLC, a U.S.-based instructional design agency headquartered in Weehawken, NJ. We design custom, SCORM/xAPI-compliant assessments and interactive quizzes for organizations using Articulate Storyline and other tools.
2. Our Services
CustomAssessment offers:
- Custom-built eLearning assessments and quizzes
- SCORM/xAPI packaging and LMS-ready exports
- AI-enhanced voiceover, avatar, and question generation (optional)
- Optional chatbot integration
- Project scoping, consulting, and design services
Services are provided on a fixed-fee or hourly basis, depending on the agreement.
3. Use of the Website
By using customassessment.com, you agree to:
- Provide accurate information when submitting forms or bookings
- Use the site only for lawful purposes
- Refrain from scraping, hacking, or reverse engineering the site
We reserve the right to restrict or terminate access if these terms are violated.
4. Project Process and Client Responsibilities
You agree to:
- Provide clear, complete project inputs and feedback in a timely manner
- Review deliverables within the mutually agreed review period
- Avoid sharing third-party copyrighted materials unless properly licensed
Project timelines depend on your input and collaboration. Delays in feedback may affect delivery dates.
5. Intellectual Property
Client Content
You retain ownership of all original materials you provide (e.g., branding, reference documents, question banks).
Final Deliverables
Unless otherwise agreed, all final deliverables (Storyline files, SCORM packages, quiz content) become your intellectual property upon full payment. We reserve the right to showcase anonymized work in our portfolio unless explicitly prohibited in writing.
Tools & Templates
We may use internally developed templates, code snippets, or question frameworks that remain our property but are licensed to you for use within the scope of your project.
6. AI-Generated Content
We may use AI services such as ChatGPT, ElevenLabs, Synthesia, HeyGen, and PlayHT to assist in the creation of voiceovers, questions, or avatars. These tools are used only for your commissioned project, and the resulting outputs are considered part of your final deliverable.
We do not use your inputs to train any AI models.
7. Payment Terms
- Invoices are due as stated on the invoice (typically within 7 or 14 days).
- Payments are accepted via Stripe or bank transfer.
- Late payments may incur a 5% monthly late fee.
- No refunds are offered for completed services.
- Failure to pay may result in withheld delivery of final files or license revocation until the balance is settled.
8. Confidentiality
We treat all client materials, strategies, and data as confidential and do not share them with third parties beyond project subcontractors under NDA.
9. Warranties and Disclaimers
- We provide services on an “as-is” basis.
- We do not guarantee compatibility with all LMS platforms unless explicitly tested or scoped.
- While we strive for accuracy and quality, we are not liable for damages resulting from errors, omissions, or delays, unless caused by gross negligence or willful misconduct.
10. Limitation of Liability
To the maximum extent permitted by law:
- We are not liable for any indirect, incidental, or consequential damages.
- Our total liability for any claim related to our services will not exceed the amount paid by you for the specific project giving rise to the claim.
11. Third-Party Services
Our services may integrate with or link to third-party platforms such as:
- Calendly / Cal.com for bookings
- Google Drive for file sharing
- AI tools for content creation
We are not responsible for any issues arising from these external platforms.
12. Termination
You may terminate a project at any time before final delivery. If terminated:
- You will be billed for work completed up to that point.
- We reserve the right to retain partial files or revoke licenses if payment is incomplete.
We may terminate projects or access in the event of breach of these Terms or if continued service is no longer viable.
13. Governing Law
These Terms are governed by the laws of the State of New Jersey, USA, without regard to conflict-of-law principles.
14. Changes to These Terms
We may update these Terms from time to time. The latest version will always be published at customassessment.com/terms. Continued use of our website or services constitutes acceptance of the updated Terms.
